1Agreeing to these conditions
In short: use of the site counts as accepting these conditions.
The conditions on this page govern how you use vectisworks.net, which Vectis Works operates. Using the site means you accept them. If you would rather not be bound by them, please don't browse the site.
2What this site is, and what it isn't
In short: it describes our services, makes no offer, and real work runs under a signed agreement.
Vectis Works uses the site to describe its work for manufacturers, which covers automation, software, dashboards and shop-floor data. It does not offer to form a contract. A project begins only once both parties have signed a separate agreement in writing. Should anything in that contract clash with these conditions, the contract takes priority.
3Sample dashboards, charts and numbers
In short: what you see is sample data, not a result and not a promise.
Every dashboard, chart and number on this site, and in the sample dashboard we link to, is built from representative sample data. Each one is there to show the type of view we build. Nothing shown comes from a client, and nothing shown is a promise about what your plant will get.
4Business emails from us
In short: we may write to you about our work, and a reply ends it.
Vectis Works may send email to professionals in roles connected to what it does. Answering any such email, at any point, is enough to stop them. The data privacy policy sets out what we keep, its sources, and how to ask about it.
5How you may use the site
In short: lawful use only, with no disruption, break-ins, probing or scraping.
The site may be used for lawful purposes only. Do not attempt to interfere with it, break into it or the systems that run it, test it for security weaknesses, or copy its content with scripts or other automated tools.
6Who owns the content
In short: the content is ours, and viewing or printing it for business reference is fine.
The words, images, logos and everything else published here are owned by Vectis Works, or by those who license material to it. You're welcome to look at pages and print copies for reference in your own business. Anything beyond that requires our permission in writing. For client projects, rights in what we deliver follow the written agreement for that project.
7Links and outside services
In short: outside sites run under their own terms, which we don't control.
From this site you can reach vectisworks.com and our sample dashboard, and the pages pull a typeface from Google Fonts. Those third parties apply their own terms and policies, and they are not our responsibility.
8No warranties
In short: the site comes as it is, for general information, and is not advice.
The site is offered "as is", on an "as available" footing, as general information and nothing more. Within the limits the law sets, we disclaim every warranty, express or implied. That includes any warranty of merchantability, any of non-infringement, any of fitness for a particular use, and any that the site will be free of errors or interruptions. Treat nothing here as advice, whether professional, engineering, financial or legal.
9Limitation of liability
In short: all liability connected with the site is capped at one hundred US dollars.
Where the law allows it, we are not liable for damages that are indirect, incidental, consequential, special or punitive, or for lost data, profits, revenue or opportunities, that come from using the site. For all claims connected with the site, our liability in total is capped at one hundred US dollars.
10Indemnity
In short: claims caused by your misuse are yours to cover.
Should claims, losses or expenses, reasonable attorneys' fees included, arise because you misused the site or broke these conditions, you agree to cover them, and to indemnify and hold harmless Vectis Works together with its owners, team members and agents.
11Governing law and disputes
In short: Tennessee law governs, and disputes are arbitrated in Nashville.
Tennessee law governs these conditions, setting aside its rules on conflict of laws. Disputes about the site or these conditions go to binding arbitration, held in Nashville, Tennessee, and run by the American Arbitration Association under its rules, unless the law does not permit arbitration.
12General
In short: one invalid part leaves the rest intact, and the date marks the version.
Should any part of these conditions prove unenforceable, every other part still applies. Our choosing not to enforce a term does not waive it. Along with the data privacy policy, these conditions are everything you and Vectis Works have agreed about the site. They may be revised, and the date shown at the top tells you which version is current.
